TREC License Suspension Defense for Frisco Sales Agents
When TREC issues a suspension order against a Frisco sales agent, the consequences extend beyond the suspended license: pending transactions stall or transfer to other agents, broker affiliation may terminate, MLS access is revoked, and E&O coverage may lapse. Suspension defense is both legal — preserving the right to practice — and practical — preserving career continuity.
Types of TREC Suspension
Definite suspension: fixed period (60 days, 6 months, etc.) after which license reactivates if conditions are met. Indefinite suspension: until specific conditions are met (CE completion, fines paid, etc.). Probated suspension: technically suspended but allowed to practice subject to terms.
Immediate Actions on Suspension
Notify your broker (broker policy may require). Notify pending transaction parties (buyer, seller, co-op brokers) of inability to proceed. Coordinate transaction transfer to another agent. Notify E&O carrier. Preserve transaction files for any subsequent dispute. None of these are optional — failure to handle pending transactions creates additional TREC exposure.
Appeal Rights
TREC suspension can be challenged at SOAH if the underlying Final Order has not yet been adopted. After Final Order, judicial review is available in Travis County district court under the Administrative Procedure Act. Strategic decision: contest now (fast, but uncertain) versus serve suspension and apply for reinstatement (longer, but predictable).
Reinstatement After Suspension
Reinstatement requires meeting all conditions of the original Order: fines paid, CE completed, any required reporting, compliance with monitoring terms. Reinstatement is generally not automatic — application must be filed with documentation of compliance. Frisco agents preparing for reinstatement should begin documentation immediately, not wait until the eve of reinstatement.
